1.The property is known as Gites in Dinan, and the property is offered for holiday rental subject to confirmation by Mr & Mrs Sullivan (the owners) to the renter (the client).
2.To reserve the property, the client should complete and sign the booking form and return it together with payment of the initial non refundable deposit (25% of the total rent due).Following receipt of the Booking Form and deposit, the owner will send a confirmation e-mail.This is the formal acceptance of the booking.The deposit will be refunded in full if for any reason the booking cannot be accepted.
3.The balance of the rent is payable not less than eight weeks before the start of the rental period (an email will be sent 1 week before the balance is due).If payment is not received by the due date, the owner reserves the right to give notice in writing that the reservation is cancelled.Reservations made within eight weeks of the start for the rental period require full payment at the time of booking.
4.A security deposit of €300 is required, in case of, for example, damage to the property or its contents.However the sum reserved by this clause shall not limit the client’s liability to the owner.The owner will account to the client for the security deposit and refund the balance within two weeks after the rental period.The deposit must be paid at the same time as the final payment, and may be paid by credit card or cheque.
·The Guest shall not be responsible for 'fair wear and tear', nor shall they be responsible for breakdown of any machinery or equipment nor for anything they could not reasonably have prevented or foreseen.
·We do not make charges for small breakages such as wine glasses, plates etc provided these are few and accidental.
·The Guests are not generally responsible for the actions of third parties unless they could reasonably have foreseen and prevented the action. (An example being if the Guest leaves the property unlocked and a thief enters through the unlocked door to remove items).
5.Subject to clauses 2 and 3 above:
It is strongly recommended that the client should arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party’s belongings etc., since these are not covered by the owners insurance.
6.The rental period shall commence at 16:00 hours on the first day and finish at 10:00 hours on the last day.The owner shall not be obliged to offer accommodation before the time stated and the client shall not be entitled to remain in the occupation after the time stated.
7.The maximum sleeping capacity must not be exceeded under any circumstances, no tent may be set up within the boundaries of the property without permission.
8.Clients must respect the internal rules and regulations particular to the property and shall use the public parking areas provided at the port, as parking is not permitted in this street.On departure a visit will normally be made in the client’s presence.If no prior appointment is made the visit may be carried out after the client’s departure.The property must be left completely clean and tidy, including the cooker, refrigerator and all equipment.
9.The client and party acquire no rights whatsoever over the property excepting occupation as a holiday let for the period booked.The client shall not sublet the property.
10.The client shall report to the owner (or owner’s agent) without delay any defects in the property or breakdown of equipment.Such as plant, machinery or appliances in the property and/or garden and arrangements for repair and/or replacement will be made by the owner or his representative as soon as possible.
11.The owner shall not be liable to the client for any temporary defect or stoppage in the supply of public services to the property, nor in respect of any equipment, plant machinery or appliance in the property and/or garden.For loss, damage or injury which is the result of adverse weather, riot, war, strikes or other matters beyond the control of the owner.For any loss, damage or inconvenience caused to or suffered by the client if the property shall be destroyed or substantially damaged before the start of the rental period.In such event the owner shall, within seven days of the notification to the client, refund to the client all sums previously paid in respect of the rental period.
12.Under no circumstance shall the owner’s liability to the client exceed the amount paid to the owner for the rental period.
13.The use of accommodation and amenities where offered such as BBQ equipment etc., is entirely at the user’s risk and no responsibility can be accepted for injury toa user or visitor and any loss or damage to the user’s or visitors belongings.
14.No responsibility can be accepted for any loss or damage to any motor vehicle or it contents.
